เงื่อนไขการรับประกันสินค้าและบริการ (Warranty Terms & Conditions)
สำหรับสินค้าภายใต้เครื่องหมายการค้า RISCO และ MAXWELL
เงื่อนไขการรับประกันสินค้าและบริการฉบับนี้ (“เงื่อนไข”) เป็นข้อตกลงระหว่าง บริษัท แมกซ์เวลล์ อินทิเกรชั่น จำกัด ทะเบียนนิติบุคคลเลขที่ 125545008518 สำนักงานตั้งอยู่เลขที่ 615 อาคารจิตต์อุทัย ถนนรามคำแหง แขวงหัวหมาก เขตบางกะปิ กรุงเทพมหานคร (“บริษัทฯ”) กับผู้ซื้อสินค้าหรือผู้ลงทะเบียนรับประกันซึ่งได้กดยอมรับเงื่อนไขฉบับนี้ (“ผู้ซื้อ”) โดยมีผลบังคับกับสินค้าภายใต้เครื่องหมายการค้า Risco และ Maxwell ที่จำหน่ายโดยบริษัทฯ หรือตัวแทนจำหน่ายที่ได้รับการแต่งตั้งอย่างเป็นทางการ
โปรดอ่านเงื่อนไขการรับประกันฉบับนี้โดยละเอียดก่อนกดยอมรับและลงทะเบียนรับประกันสินค้า การกดยอมรับถือว่าท่านได้อ่าน เข้าใจ และตกลงผูกพันตามเงื่อนไขทุกข้อ
1. ขอบเขตการรับประกัน
1.1 บริษัทฯ รับประกันสินค้าเฉพาะสินค้าที่จำหน่ายภายใต้เครื่องหมายการค้า Risco และ Maxwell ซึ่งรวมถึงสินค้ากลุ่มระบบอัตโนมัติ (Automation) ภายใต้เครื่องหมายการค้า Risco เป็นระยะเวลา 3 ปี โดยเริ่มนับจากวันที่ส่งมอบงานแล้วเสร็จ หรือวันที่ผู้ซื้อชำระเงินงวดสุดท้ายครบถ้วน แล้วแต่วันใดจะถึงก่อน (“วันเริ่มนับการรับประกัน”) ทั้งนี้ วันส่งมอบงานแล้วเสร็จให้ยึดตามเอกสารส่งมอบงาน ใบส่งสินค้า หรือหลักฐานการรับมอบที่คู่สัญญาลงนามหรือรับทราบร่วมกัน และวันชำระเงินงวดสุดท้ายให้ยึดตามหลักฐานการรับชำระเงินของบริษัทฯ หรือผู้แทนจำหน่ายที่ได้รับการแต่งตั้งอย่างเป็นทางการ กรณีการซื้อสินค้าทั่วไปที่ไม่มีการส่งมอบงานเป็นงวดงาน ให้นับจากวันที่ระบุในใบกำกับภาษีหรือหลักฐานการซื้อ ทั้งนี้ การพิจารณาว่าสินค้าใดอยู่ภายใต้เครื่องหมายการค้า Risco หรือ Maxwell ให้ยึดตามเครื่องหมายการค้าที่ปรากฏบนตัวสินค้า บรรจุภัณฑ์ หรือเอกสารข้อมูลผลิตภัณฑ์ของผู้ผลิตเป็นสำคัญ
กรณีผู้ซื้อไม่สามารถแสดงหลักฐานการซื้อ เอกสารส่งมอบงาน หรือหลักฐานการชำระเงินได้ บริษัทฯ จะนับระยะเวลาการรับประกันจากวันที่ผลิตซึ่งระบุบนตัวสินค้าหรือตรวจสอบได้จากหมายเลขเครื่อง (Serial Number) บวกระยะเวลา 90 วัน หรือสงวนสิทธิปฏิเสธการให้บริการตามการรับประกันหากไม่สามารถตรวจสอบแหล่งที่มาของสินค้าได้
1.2 การรับประกันครอบคลุมเฉพาะความชำรุดบกพร่องอันเกิดจากกระบวนการผลิตหรือความบกพร่องของวัสดุ ภายใต้การติดตั้ง การใช้งาน และการบำรุงรักษาที่เป็นไปตามคู่มือ ข้อกำหนด และคำแนะนำของผู้ผลิต ทั้งนี้ สินค้าต้องได้รับการติดตั้งและใช้งานภายใต้สภาพแวดล้อม อุณหภูมิ ความชื้น และเงื่อนไขการทำงานตามที่ระบุในข้อมูลจำเพาะทางเทคนิคของผู้ผลิต การใช้งานในสภาพแวดล้อมที่เกินกว่าข้อกำหนดดังกล่าวไม่อยู่ในขอบเขตการรับประกัน เว้นแต่บริษัทฯ ได้ตรวจสอบหน้างานและยืนยันความเหมาะสมเป็นลายลักษณ์อักษรก่อนการติดตั้ง
1.3 เมื่อบริษัทฯ ตรวจสอบแล้วพบว่าความชำรุดบกพร่องอยู่ภายใต้เงื่อนไขการรับประกัน บริษัทฯ จะดำเนินการซ่อมแซม เปลี่ยนชิ้นส่วน หรือเปลี่ยนสินค้า ตามความเหมาะสมของลักษณะความเสียหาย โดยอ้างอิงหลักวิศวกรรม หลักวิชาการ และข้อกำหนดทางเทคนิคของผู้ผลิต เพื่อให้สินค้าสามารถกลับมาใช้งานได้ตามวัตถุประสงค์เดิม
1.4 หากบริษัทฯ ตรวจสอบแล้วพบว่าไม่สามารถซ่อมแซมสินค้าให้กลับมาใช้งานได้ตามปกติ บริษัทฯ จะดำเนินการเปลี่ยนสินค้าเป็นรุ่นเดียวกัน หรือรุ่นที่มีคุณสมบัติ หน้าที่การใช้งาน และสมรรถนะทางเทคนิคเทียบเท่าหรือดีกว่า โดยอ้างอิงข้อมูลจำเพาะทางเทคนิค (Technical Specification) เอกสารผลิตภัณฑ์ (Product Datasheet) หรือข้อมูลทางวิศวกรรมของผู้ผลิต
1.5 หากสินค้ารุ่นเดิมเลิกผลิต (End of Life : EOL) ไม่มีอะไหล่ ไม่มีสินค้าคงคลัง หรือผู้ผลิตยุติการสนับสนุนผลิตภัณฑ์ (End of Support : EOS) บริษัทฯ จะจัดหาสินค้ารุ่นอื่นมาทดแทน โดยสินค้าทดแทนต้องมีคุณสมบัติ หน้าที่การใช้งาน และสมรรถนะทางเทคนิคโดยรวมเทียบเท่าหรือดีกว่า ทั้งนี้ การพิจารณาความเทียบเท่าให้ยึดตามข้อมูลจำเพาะทางเทคนิค เอกสารผลิตภัณฑ์ของผู้ผลิต และหลักวิศวกรรมที่สามารถตรวจสอบได้
1.6 การพิจารณาความเทียบเท่าของสินค้าทดแทนให้พิจารณาจากปัจจัยสำคัญ เช่น หน้าที่การใช้งาน ประสิทธิภาพ ความสามารถในการทำงานร่วมกับระบบเดิม คุณลักษณะทางไฟฟ้า มาตรฐานผลิตภัณฑ์ และคุณสมบัติทางเทคนิคอื่นที่เกี่ยวข้อง โดยไม่ยึดถือจากชื่อรุ่น ปีที่ผลิต รูปลักษณ์ภายนอก สี ราคา หรือมูลค่าทางการค้าเพียงอย่างเดียว
1.7 การเปลี่ยนสินค้าเป็นสินค้าทดแทนตามข้อ 1.4 หรือ 1.5 ไม่ก่อให้เกิดสิทธิของผู้ซื้อในการเรียกร้องสินค้ารุ่นล่าสุด สินค้าที่มีราคาสูงกว่า คุณสมบัติเพิ่มเติม หรืออุปกรณ์เสริมที่ไม่ได้มีอยู่ในสินค้ารุ่นเดิม เว้นแต่จะมีข้อตกลงเป็นลายลักษณ์อักษรระหว่างคู่สัญญา
1.8 การรับประกันนี้ครอบคลุมเฉพาะตัวสินค้า ไม่รวมค่าแรง ค่าบริการ ค่าเดินทาง ค่าขนส่ง ค่าเช่าอุปกรณ์ ค่าเช่านั่งร้าน ค่ารถกระเช้า หรือค่าใช้จ่ายอื่น เว้นแต่บริษัทฯ จะระบุไว้เป็นอย่างอื่น
1.9 การรับประกันนี้ไม่ครอบคลุมสินค้า อุปกรณ์ ส่วนควบ อุปกรณ์ประกอบ อุปกรณ์เสริม หรือชิ้นส่วนใด ๆ ที่จำหน่ายภายใต้เครื่องหมายการค้าอื่นนอกเหนือจาก Risco และ Maxwell แม้ว่าสินค้าหรืออุปกรณ์ดังกล่าวจะจำหน่ายหรือติดตั้งโดยบริษัทฯ หรือได้รับการติดตั้งร่วม เชื่อมต่อ หรือทำงานร่วมกับสินค้า Risco หรือ Maxwell ภายในระบบเดียวกันก็ตาม โดยสินค้าภายใต้เครื่องหมายการค้าอื่นให้เป็นไปตามเงื่อนไขการรับประกันและกระบวนการเคลมของผู้ผลิตหรือผู้จัดจำหน่ายแต่ละราย ทั้งนี้ บริษัทฯ ยินดีเป็นผู้ประสานงานการเคลมให้ตามสมควร
2. บริการ ณ สถานที่ติดตั้ง (Onsite Service)
2.1 บริษัทฯ ให้บริการ Onsite Service โดยไม่คิดค่าแรง ค่าบริการ และค่าเดินทาง เป็นระยะเวลา 1 ปี นับจากวันเริ่มนับการรับประกันตามข้อ 1.1 ทั้งนี้ สิทธิดังกล่าวครอบคลุมเฉพาะการปฏิบัติงานภายในวันและเวลาทำการปกติตามข้อ 2.7 และไม่รวมค่าใช้จ่ายตามข้อ 1.8 ข้อ 2.8 และข้อ 2.9
2.2 สิทธิการให้บริการโดยไม่คิดค่าเดินทางตามข้อ 2.1 ครอบคลุมจุดให้บริการ (สถานที่ติดตั้งสินค้า) ที่อยู่ห่างจากสถานประกอบการของบริษัทฯ หรือสถานที่ตั้งของผู้แทนจำหน่ายที่ได้รับการแต่งตั้งอย่างเป็นทางการซึ่งเป็นผู้รับผิดชอบการให้บริการในครั้งนั้น ไม่เกิน 50 กิโลเมตร โดยวัดระยะทางขาไปเพียงขาเดียวจากจุดต้นทางถึงจุดให้บริการ ทั้งนี้ บริษัทฯ เป็นผู้กำหนดหน่วยงานผู้รับผิดชอบการให้บริการแต่ละครั้งตามความเหมาะสม
2.3 การคำนวณระยะทางให้ยึดตามเส้นทางการเดินรถจริงที่สั้นที่สุดจากระบบแผนที่ดิจิทัลที่บริษัทฯ ใช้อ้างอิง กรณีจุดให้บริการอยู่ห่างเกินกว่า 50 กิโลเมตร (วัดขาไปขาเดียว) ผู้ซื้อเป็นผู้รับผิดชอบค่าเดินทางเฉพาะระยะทางส่วนที่เกิน โดยคำนวณจากระยะทางส่วนเกินทั้งขาไปและขากลับ (ไป-กลับ) คูณอัตราต่อกิโลเมตรที่บริษัทฯ ประกาศใช้ หรือตามที่ตกลงกันเป็นลายลักษณ์อักษรก่อนเข้าปฏิบัติงาน ตัวอย่างเช่น หากจุดให้บริการอยู่ห่าง 70 กิโลเมตร ระยะทางส่วนเกินเท่ากับ 20 กิโลเมตร ผู้ซื้อรับผิดชอบค่าเดินทางส่วนเกิน 20 × 2 = 40 กิโลเมตร นอกจากนี้ กรณีการเดินทางเข้าให้บริการมีความจำเป็นต้องพักแรม หรือมีค่าใช้จ่ายในการเดินทางลักษณะพิเศษ เช่น ค่าเรือข้ามฟาก ค่าโดยสารเรือ หรือค่ายานพาหนะพิเศษอื่นใด (ถ้ามี) ผู้ซื้อเป็นผู้รับผิดชอบค่าที่พักและค่าใช้จ่ายดังกล่าวตามที่เกิดขึ้นจริง โดยบริษัทฯ จะแจ้งประมาณการให้ผู้ซื้อพิจารณาอนุมัติก่อนเข้าปฏิบัติงาน
2.4 เมื่อพ้นระยะเวลา 1 ปี ผู้ซื้อยังคงได้รับสิทธิรับประกันตัวสินค้าให้ครบระยะเวลา 3 ปี แต่ผู้ซื้อเป็นผู้รับผิดชอบค่าแรง ค่าเดินทาง ค่าขนส่ง และค่าใช้จ่ายอื่นที่เกี่ยวข้องกับการให้บริการ
2.5 บริษัทฯ อาจให้บริการผ่าน Remote Support ก่อน เพื่อวิเคราะห์หรือแก้ไขปัญหาเบื้องต้น หากสามารถแก้ไขได้โดยไม่จำเป็นต้องเข้าพื้นที่ ให้ถือว่าเป็นการให้บริการตามการรับประกันแล้ว
2.6 บริษัทฯ จะกำหนดรูปแบบการให้บริการโดยอ้างอิงลักษณะของปัญหา ความปลอดภัย ความเหมาะสมทางวิศวกรรม และประสิทธิภาพในการแก้ไขปัญหา ทั้งนี้ บริษัทฯ อาจกำหนดให้ส่งสินค้าเข้าตรวจสอบก่อนเข้าดำเนินการ ณ สถานที่ติดตั้ง หากเห็นว่าเป็นแนวทางที่เหมาะสมกว่า
2.7 การให้บริการโดยไม่คิดค่าแรง ค่าบริการ และค่าเดินทางตามข้อ 2.1 ครอบคลุมเฉพาะการปฏิบัติงานภายในวันและเวลาทำการปกติของบริษัทฯ คือวันจันทร์ถึงวันศุกร์ เวลา 08.30–17.30 น. ยกเว้นวันหยุดนักขัตฤกษ์และวันหยุดตามประกาศของบริษัทฯ ในกรณีที่ผู้ซื้อหรือข้อกำหนดของสถานที่ติดตั้งกำหนดให้ปฏิบัติงานนอกวันหรือเวลาดังกล่าว เช่น การปฏิบัติงานในเวลากลางคืน วันเสาร์ วันอาทิตย์ วันหยุด หรือช่วงหยุดการผลิต (Plant Shutdown) ผู้ซื้อเป็นผู้รับผิดชอบค่าล่วงเวลา ค่าปฏิบัติงานนอกเวลาทำการ และค่าใช้จ่ายส่วนเพิ่มที่เกี่ยวข้อง ตามอัตราที่บริษัทฯ ประกาศใช้หรือตามที่ตกลงกันเป็นลายลักษณ์อักษรก่อนเข้าปฏิบัติงาน ทั้งนี้ แม้อยู่ภายในระยะเวลาการรับประกันหรือระยะเวลา Onsite Service ตามข้อ 2.1 ก็ตาม
2.8 กรณีสินค้าติดตั้งอยู่ในตำแหน่งหรือพื้นที่ที่มีข้อจำกัดในการเข้าถึง เช่น ที่สูงเกินกว่าการปฏิบัติงานด้วยบันไดมาตรฐานของช่างบริการ พื้นที่ที่ต้องใช้นั่งร้าน รถกระเช้า เครื่องจักรสำหรับการยกหรือขึ้นที่สูง พื้นที่อับอากาศ หรือพื้นที่ที่ต้องใช้อุปกรณ์หรือมาตรการพิเศษอื่นใดในการเข้าถึง ผู้ซื้อมีหน้าที่จัดเตรียมอุปกรณ์ดังกล่าวพร้อมผู้ควบคุม (ถ้ามี) ให้พร้อมก่อนวันนัดหมาย หรือรับผิดชอบค่าเช่า ค่าติดตั้ง ค่ารื้อถอน และค่าใช้จ่ายที่เกี่ยวข้องทั้งหมด โดยค่าใช้จ่ายส่วนนี้ไม่อยู่ในขอบเขตของการรับประกันและบริการ Onsite Service โดยไม่คิดค่าใช้จ่ายตามข้อ 2.1 ไม่ว่ากรณีใด
2.9 กรณีสถานที่ติดตั้งมีข้อกำหนดหรือระเบียบการเข้าปฏิบัติงานเป็นการเฉพาะ เช่น การอบรมความปลอดภัยก่อนเข้าพื้นที่ การขอใบอนุญาตทำงาน (Work Permit) การจัดให้มีผู้ควบคุมงานหรือผู้เฝ้าระวัง อุปกรณ์คุ้มครองความปลอดภัยส่วนบุคคลชนิดพิเศษ เอกสารรับรอง การตรวจสุขภาพ การทำประกันภัยเพิ่มเติม หรือการรอผู้นำทางเข้าพื้นที่ ผู้ซื้อมีหน้าที่แจ้งข้อกำหนดดังกล่าวให้บริษัทฯ ทราบล่วงหน้าก่อนการนัดหมาย และเป็นผู้รับผิดชอบค่าใช้จ่าย ค่าธรรมเนียม รวมถึงค่าแรงหรือค่าบริการส่วนเพิ่มอันเกิดจากระยะเวลาที่ต้องใช้ในการปฏิบัติตามข้อกำหนดดังกล่าว ตามอัตราที่บริษัทฯ ประกาศใช้ หากผู้ซื้อไม่แจ้งล่วงหน้าและเป็นเหตุให้บริษัทฯ ไม่สามารถปฏิบัติงานได้ในวันนัดหมาย ให้นำความในข้อ 6.2 มาใช้บังคับ
2.10 บริการ Onsite Service ตามเงื่อนไขฉบับนี้เป็นการให้บริการตามการนัดหมายล่วงหน้าโดยพิจารณาจากคิวงานและความพร้อมของทั้งสองฝ่าย มิใช่ข้อตกลงระดับการให้บริการ (Service Level Agreement : SLA) และไม่ถือเป็นการรับรองระยะเวลาตอบสนองหรือระยะเวลาแก้ไขแล้วเสร็จ รวมทั้งไม่รวมถึงการจัดหาอุปกรณ์สำรองระหว่างการซ่อม (Loan Unit) กรณีผู้ซื้อประสงค์ระยะเวลาตอบสนองที่กำหนดแน่นอน บริการนอกเวลาทำการเป็นการประจำ อุปกรณ์สำรองระหว่างการซ่อม หรือการบำรุงรักษาเชิงป้องกันตามรอบเวลา สามารถจัดทำเป็นสัญญาบริการบำรุงรักษา (Maintenance Agreement) แยกต่างหากตามข้อเสนอของบริษัทฯ
2.11 เพื่อประโยชน์ในการวิเคราะห์และแก้ไขปัญหาอย่างรวดเร็วตามข้อ 2.5 ผู้ซื้อมีหน้าที่อำนวยความสะดวกในการเข้าถึงระบบจากระยะไกลตามสมควร เช่น การอนุญาตการเชื่อมต่อเครือข่าย การประสานงานกับหน่วยงานเทคโนโลยีสารสนเทศของผู้ซื้อ หรือการจัดให้มีผู้ประสานงานหน้างาน หากไม่สามารถให้บริการจากระยะไกลได้ด้วยข้อจำกัดจากฝ่ายผู้ซื้อ บริษัทฯ จะนัดหมายเข้าปฏิบัติงาน ณ สถานที่ติดตั้งตามเงื่อนไขในหมวดนี้
3. ขั้นตอนการขอรับบริการ
3.1 ผู้ขอรับบริการต้องแสดงหลักฐานการซื้อที่สามารถตรวจสอบได้
3.2 ต้องแจ้งรุ่นสินค้า หมายเลข Serial Number รายละเอียดอาการเสีย สถานที่ติดตั้ง พร้อมภาพถ่ายหรือข้อมูลที่จำเป็นต่อการวิเคราะห์ปัญหา
3.3 บริษัทฯ อาจขอให้ผู้ซื้อดำเนินการตรวจสอบหรือทดสอบเบื้องต้นตามคำแนะนำของฝ่ายบริการก่อนรับสินค้าเข้าตรวจสอบหรือเข้าพื้นที่
3.4 หากตรวจสอบแล้วพบว่าสินค้าอยู่ในสภาพปกติ หรือปัญหาไม่ได้เกิดจากตัวสินค้า (No Fault Found : NFF) บริษัทฯ มีสิทธิเรียกเก็บค่าตรวจสอบ ค่าแรง ค่าเดินทาง และค่าใช้จ่ายอื่นที่เกิดขึ้นจริงตามอัตราที่บริษัทฯ ประกาศใช้
3.5 หากพบว่าความเสียหายไม่อยู่ภายใต้เงื่อนไขการรับประกัน บริษัทฯ จะแจ้งรายละเอียดและค่าใช้จ่ายให้ผู้ซื้อทราบก่อนดำเนินการ
4. สิทธิการรับประกัน
4.1 การรับประกันตัวสินค้าและบริการ Onsite Service เป็นสิทธิที่แยกออกจากกัน การได้รับสิทธิประเภทหนึ่งไม่ก่อให้เกิดสิทธิอีกประเภทหนึ่ง
4.2 การซ่อม เปลี่ยนชิ้นส่วน หรือเปลี่ยนสินค้า ไม่ทำให้ระยะเวลาการรับประกันเริ่มนับใหม่ และไม่ขยายระยะเวลาการรับประกันเดิม
4.3 สิทธิการรับประกันเป็นของตัวสินค้า โดยผู้ขอรับบริการต้องมีหลักฐานการซื้อที่สามารถตรวจสอบได้
5. ข้อยกเว้นการรับประกัน
การรับประกันไม่ครอบคลุมกรณีดังต่อไปนี้
5.1 การติดตั้งหรือใช้งานไม่เป็นไปตามคู่มือหรือข้อกำหนดของผู้ผลิต
5.2 การดัดแปลง แก้ไข ซ่อมแซม หรือเปลี่ยนแปลงสินค้าโดยบุคคลที่ไม่ได้รับอนุญาตจากบริษัทฯ
5.3 ความเสียหายจากการตกหล่น กระแทก อุบัติเหตุ หรือการใช้งานผิดวิธี
5.4 ความเสียหายจากไฟตก ไฟเกิน ไฟกระชาก ฟ้าผ่า ไฟฟ้าลัดวงจร หรือระบบไฟฟ้าที่ไม่เป็นไปตามข้อกำหนดของผู้ผลิต
5.5 ความเสียหายจากน้ำ ความชื้น สารเคมี ฝุ่น แมลง หนู หรือสัตว์ ทั้งนี้ เฉพาะกรณีที่สภาพดังกล่าวอยู่ในระดับที่เกินกว่าข้อกำหนดสภาพแวดล้อมการใช้งาน (Environmental Specifications) ของผู้ผลิตสำหรับสินค้ารุ่นนั้น
5.6 ความเสียหายจากอัคคีภัย น้ำท่วม แผ่นดินไหว ภัยธรรมชาติ หรือเหตุสุดวิสัย
5.7 หมายเลข Serial Number หรือสติกเกอร์รับประกันถูกลบ แก้ไข หรือไม่สามารถตรวจสอบได้
5.8 ความเสียหายจากการใช้งานร่วมกับอุปกรณ์ที่ไม่เป็นไปตามข้อกำหนดของผู้ผลิต
5.9 ความเสียหายของข้อมูล ซอฟต์แวร์ เฟิร์มแวร์ หรือการตั้งค่าของระบบ
5.10 วัสดุสิ้นเปลือง เช่น แบตเตอรี่ ฟิวส์ หลอดไฟ สายเชื่อมต่อ หรือวัสดุที่มีการสึกหรอตามอายุการใช้งาน เว้นแต่เกิดจากความบกพร่องในการผลิต
5.11 สินค้า อุปกรณ์ ส่วนควบ อุปกรณ์ประกอบ หรืออุปกรณ์เสริมภายใต้เครื่องหมายการค้าอื่นนอกเหนือจาก Risco และ Maxwell ตามข้อ 1.9 รวมถึงความเสียหายของสินค้า Risco หรือ Maxwell อันมีสาเหตุมาจากความบกพร่องหรือการทำงานผิดปกติของสินค้าหรืออุปกรณ์ภายใต้เครื่องหมายการค้าอื่นดังกล่าว
6. ค่าใช้จ่ายที่ผู้ซื้อรับผิดชอบ
6.1 หากตรวจสอบแล้วพบว่าความเสียหายไม่อยู่ภายใต้การรับประกัน ผู้ซื้อรับผิดชอบค่าตรวจสอบ ค่าแรง ค่าอะไหล่ ค่าเดินทาง ค่าขนส่ง และค่าใช้จ่ายอื่นที่เกี่ยวข้องตามอัตราที่บริษัทฯ ประกาศใช้
6.2 หากบริษัทฯ เดินทางเข้าพื้นที่ตามวันและเวลาที่นัดหมาย แต่ไม่สามารถปฏิบัติงานได้เนื่องจากผู้ซื้อไม่พร้อม ไม่อยู่ในสถานที่ ไม่สามารถเข้าถึงพื้นที่ติดตั้ง หรือเกิดเหตุจากฝ่ายผู้ซื้อ ผู้ซื้อรับผิดชอบค่าเดินทางและค่าใช้จ่ายที่เกิดขึ้นจริง
6.3 การแจ้งเคลม การส่งสินค้าตรวจสอบ หรือการใช้สิทธิรับประกัน ไม่เป็นเหตุให้ผู้ซื้อระงับ ชะลอ หรือปฏิเสธการชำระเงินที่ถึงกำหนดชำระ เว้นแต่กฎหมายกำหนดไว้
6.4 อัตราค่าบริการ ค่าเดินทางส่วนเกิน ค่าปฏิบัติงานนอกเวลาทำการ และอัตราอื่นที่บริษัทฯ ประกาศใช้ตามเงื่อนไขฉบับนี้ จะเผยแพร่บนเว็บไซต์ของบริษัทฯ และแจ้งให้ผู้ซื้อทราบเมื่อร้องขอ ทั้งนี้ ก่อนดำเนินการใดที่มีค่าใช้จ่าย บริษัทฯ จะแจ้งประมาณการค่าใช้จ่ายให้ผู้ซื้อพิจารณาอนุมัติก่อนทุกครั้ง
7. ขอบเขตความรับผิดของบริษัทฯ
7.1 ความรับผิดของบริษัทฯ ภายใต้การรับประกันฉบับนี้ จำกัดอยู่เฉพาะการซ่อมแซม เปลี่ยนชิ้นส่วน หรือเปลี่ยนสินค้าตามเงื่อนไขที่กำหนด
7.2 บริษัทฯ ไม่รับผิดชอบต่อความเสียหายทางอ้อม ความเสียหายต่อเนื่อง การสูญเสียข้อมูล การสูญเสียกำไร การสูญเสียรายได้ การหยุดชะงักของธุรกิจ หรือค่าเสียหายอื่นที่เกิดขึ้นต่อเนื่องจากการใช้หรือไม่สามารถใช้สินค้าได้ เว้นแต่ความรับผิดดังกล่าวจะเกิดจากการกระทำโดยจงใจหรือประมาทเลินเล่ออย่างร้ายแรงของบริษัทฯ หรือเป็นกรณีที่กฎหมายกำหนดให้ต้องรับผิด
8. การลงทะเบียนรับประกันและการยอมรับเงื่อนไข
8.1 ผู้ซื้อสามารถลงทะเบียนรับประกันสินค้าผ่านช่องทางที่บริษัทฯ กำหนด โดยต้องกรอกข้อมูลที่ถูกต้อง ครบถ้วน และเป็นความจริง ได้แก่ ชื่อ-นามสกุลหรือชื่อนิติบุคคล ข้อมูลการติดต่อ รุ่นสินค้า หมายเลข Serial Number วันที่ซื้อ สถานที่ติดตั้ง และหลักฐานการซื้อ
8.2 การกดยอมรับเงื่อนไขฉบับนี้ผ่านระบบลงทะเบียนออนไลน์ ถือเป็นการแสดงเจตนายอมรับข้อกำหนดและเงื่อนไขทุกข้อโดยชอบด้วยกฎหมาย และมีผลผูกพันเช่นเดียวกับการลงลายมือชื่อในเอกสาร โดยบริษัทฯ จะจัดเก็บบันทึกการยอมรับ วันและเวลาที่ยอมรับ และเวอร์ชันของเงื่อนไขที่มีผลบังคับใช้ ณ ขณะนั้น ไว้เป็นหลักฐาน
8.3 กรณีผู้ลงทะเบียนกระทำการแทนนิติบุคคลหรือบุคคลอื่น ผู้ลงทะเบียนรับรองว่าตนมีอำนาจกระทำการแทนโดยชอบ
8.4 การให้ข้อมูลอันเป็นเท็จ ไม่ถูกต้อง หรือไม่ครบถ้วนในสาระสำคัญ อาจมีผลให้สิทธิตามการรับประกันสิ้นสุดลงหรือถูกปฏิเสธการให้บริการ
8.5 บริษัทฯ จะเก็บรวบรวม ใช้ และประมวลผลข้อมูลส่วนบุคคลของผู้ลงทะเบียนเพียงเท่าที่จำเป็นเพื่อการลงทะเบียนรับประกัน การให้บริการ และการติดต่อที่เกี่ยวข้อง ตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 โดยรายละเอียดเป็นไปตามนโยบายความเป็นส่วนตัวของบริษัทฯ
8.6 สิทธิการรับประกัน 3 ปีตามหมวด 1 และสิทธิ Onsite Service ตามหมวด 2 ของเงื่อนไขฉบับนี้ เป็นสิทธิพิเศษที่บริษัทฯ มอบให้แก่ผู้ซื้อที่ลงทะเบียนรับประกันและกดยอมรับเงื่อนไขภายใน 60 วันนับจากวันเริ่มนับการรับประกันตามข้อ 1.1 กรณีไม่ลงทะเบียนภายในกำหนด ผู้ซื้อยังคงมีสิทธิตามที่กฎหมายบัญญัติ โดยบริษัทฯ อาจพิจารณาให้สิทธิตามเงื่อนไขฉบับนี้เป็นรายกรณีเมื่อผู้ซื้อแสดงหลักฐานการซื้อที่ตรวจสอบได้
9. ข้อกำหนดทั่วไป
9.1 การตรวจสอบสาเหตุของความชำรุดบกพร่องและการพิจารณาสิทธิการรับประกัน ให้เป็นไปตามหลักวิศวกรรม หลักวิชาการ มาตรฐานอุตสาหกรรม และข้อมูลทางเทคนิคของผู้ผลิตที่สามารถตรวจสอบได้
9.2 บริษัทฯ สงวนสิทธิในการปรับปรุงหรือแก้ไขเงื่อนไขฉบับนี้ตามความเหมาะสม โดยเงื่อนไขที่มีผลบังคับกับสินค้าแต่ละรายการให้ยึดตามเวอร์ชันที่ผู้ซื้อได้ยอมรับ ณ วันที่ลงทะเบียนรับประกัน
9.3 หากข้อกำหนดข้อใดของเงื่อนไขฉบับนี้ตกเป็นโมฆะหรือไม่สามารถใช้บังคับได้ ให้ถือว่าเฉพาะข้อกำหนดนั้นไม่มีผลใช้บังคับ โดยไม่กระทบต่อความสมบูรณ์และการบังคับใช้ของข้อกำหนดอื่น
9.4 เงื่อนไขการรับประกันฉบับนี้อยู่ภายใต้บังคับแห่งกฎหมายไทย
9.5 เงื่อนไขฉบับนี้ไม่มีผลเป็นการจำกัดหรือตัดสิทธิใดของผู้ซื้อซึ่งเป็นผู้บริโภคตามที่กฎหมายว่าด้วยการคุ้มครองผู้บริโภค กฎหมายว่าด้วยความรับผิดต่อความเสียหายที่เกิดขึ้นจากสินค้าที่ไม่ปลอดภัย หรือกฎหมายอื่นที่เกี่ยวข้องบัญญัติรับรองไว้ หากข้อกำหนดใดขัดกับสิทธิดังกล่าว ให้ใช้บังคับเท่าที่ไม่ขัดต่อกฎหมายนั้น
9.6 เงื่อนไขฉบับนี้จัดทำเป็นภาษาไทย กรณีมีการแปลเป็นภาษาอื่นและข้อความขัดแย้งกัน ให้ยึดฉบับภาษาไทยเป็นหลัก
Product Warranty Terms and Conditions
For Products Sold Under the RISCO and MAXWELL Trademarks
These Product Warranty Terms and Conditions (these “Terms”) constitute a binding agreement between MAXWELL INTEGRATION COMPANY LIMITED. a company incorporated under the laws of Thailand with juristic person registration number 125545008518, having its registered office at 615 Jitt-Uthai Building, Ramkhamhaeng Road, Hua Mak Sub-district, Bang Kapi District, Bangkok, Thailand (the “Company”), and the purchaser of the Products or the person registering the warranty who has clicked to accept these Terms (the “Purchaser”). These Terms shall apply to products sold under the Risco and Maxwell trademarks by the Company or by its officially appointed authorized dealers (the “Products”).
Please read these Terms carefully and in their entirety before clicking to accept and registering the product warranty. By clicking to accept, the Purchaser acknowledges that the Purchaser has read, understood, and agreed to be bound by each and every provision of these Terms.
1. Scope of Warranty
1.1 The Company warrants only Products sold under the Risco and Maxwell trademarks, which shall include automation products (Automation) sold under the Risco trademark, for a period of 3 (three) years commencing on the date of completed work handover or the date on which the Purchaser makes full payment of the final installment, whichever occurs first (the “Warranty Commencement Date”). The date of completed work handover shall be determined by reference to the work handover document, delivery note, or other evidence of acceptance signed or acknowledged by both parties, and the date of final installment payment shall be determined by reference to the payment receipt records of the Company or its officially appointed authorized dealer. In the case of a general product purchase not involving milestone-based work handover, the warranty period shall commence on the date stated in the tax invoice or proof of purchase. For the purpose of determining whether any product falls under the Risco or Maxwell trademark, the trademark appearing on the product itself, its packaging, or the manufacturer’s product documentation shall be conclusive.
In the event that the Purchaser is unable to produce proof of purchase, a work handover document, or evidence of payment, the Company shall calculate the warranty period from the date of manufacture indicated on the product or verifiable from the product’s serial number, plus a period of 90 (ninety) days, or the Company reserves the right to refuse warranty service where the origin of the product cannot be verified.
1.2 This warranty covers only defects arising from the manufacturing process or defects in materials, provided that the Product has been installed, used, and maintained in accordance with the manuals, specifications, and instructions of the manufacturer. The Product must be installed and operated within the environmental conditions, temperature, humidity, and operating parameters specified in the manufacturer’s technical specifications. Use of the Product in conditions exceeding such specifications shall fall outside the scope of this warranty, unless the Company has conducted a site survey and confirmed the suitability of the installation environment in writing prior to installation.
1.3 Where the Company, upon inspection, determines that a defect falls within the scope of this warranty, the Company shall repair the Product, replace the defective parts, or replace the Product, as appropriate to the nature of the damage, by reference to engineering principles, recognized technical standards, and the manufacturer’s technical specifications, so as to restore the Product to its intended functional condition.
1.4 Where the Company, upon inspection, determines that the Product cannot be repaired to its normal working condition, the Company shall replace the Product with the same model, or with a model having equivalent or superior features, functionality, and technical performance, by reference to the manufacturer’s technical specifications, product datasheets, or engineering documentation.
1.5 Where the original model has been discontinued (End of Life: EOL), spare parts are unavailable, stock is unavailable, or the manufacturer has ceased product support (End of Support: EOS), the Company shall procure a substitute model, provided that such substitute shall have overall features, functionality, and technical performance equivalent to or superior to the original Product. Equivalence shall be determined by reference to the manufacturer’s technical specifications, product documentation, and verifiable engineering principles.
1.6 The equivalence of any substitute product shall be assessed on the basis of material factors including, without limitation, functionality, performance, compatibility with the existing system, electrical characteristics, product standards, and other relevant technical attributes, and shall not be determined solely by reference to model name, year of manufacture, external appearance, color, price, or commercial value.
1.7 The replacement of a Product with a substitute product pursuant to Clause 1.4 or Clause 1.5 shall not entitle the Purchaser to claim the latest model, a higher-priced product, additional features, or accessories not included in the original Product, unless otherwise agreed in writing between the parties.
1.8 This warranty covers the Product itself only and does not include labor charges, service charges, travel expenses, transportation costs, equipment rental, scaffolding rental, aerial work platform (boom/cherry picker) charges, or any other expenses, unless otherwise expressly specified by the Company.
1.9 This warranty does not cover any product, equipment, fixture, component, accessory, attachment, or part sold under any trademark other than Risco and Maxwell, notwithstanding that such product or equipment may have been sold or installed by the Company, or installed together with, connected to, or operated in conjunction with Risco or Maxwell Products within the same system. Products sold under other trademarks shall be subject to the warranty terms and claim procedures of their respective manufacturers or distributors. The Company shall, however, be pleased to provide reasonable assistance in coordinating such claims.
2. Onsite Service
2.1 The Company shall provide Onsite Service free of labor charges, service charges, and travel expenses for a period of 1 (one) year from the Warranty Commencement Date under Clause 1.1, provided that such entitlement shall apply only to work performed during the Company’s normal business days and hours as set out in Clause 2.7, and shall not include the expenses referred to in Clause 1.8, Clause 2.8, and Clause 2.9.
2.2 The entitlement to service free of travel expenses under Clause 2.1 shall apply to service locations (the Product installation site) situated not more than 50 (fifty) kilometers, measured one-way from the point of origin to the service location, from the Company’s place of business or from the premises of the officially appointed authorized dealer responsible for the service on that occasion. The Company shall designate the responsible service unit for each service visit at its reasonable discretion.
2.3 Distances shall be calculated based on the shortest actual driving route as determined by the digital mapping system used by the Company as its reference. Where the service location is situated more than 50 (fifty) kilometers away (measured one-way), the Purchaser shall be responsible for travel expenses in respect of the excess distance only, calculated on the basis of the excess distance for both the outbound and return journeys (round trip), multiplied by the per-kilometer rate published by the Company, or as otherwise agreed in writing prior to commencement of the work. By way of illustration: where the service location is situated 70 kilometers away, the excess distance is 20 kilometers, and the Purchaser shall be responsible for travel expenses in respect of 20 × 2 = 40 kilometers.
Furthermore, where a service visit necessitates overnight accommodation, or involves special travel expenses such as ferry charges, boat fares, or any other special means of transportation (if any), the Purchaser shall be responsible for such accommodation and travel expenses as actually incurred, provided that the Company shall submit an estimate of such expenses to the Purchaser for approval prior to commencement of the work.
2.4 Upon expiry of the said 1 (one) year period, the Purchaser shall continue to be entitled to the product warranty for the remainder of the 3 (three) year warranty period, provided that the Purchaser shall be responsible for labor charges, travel expenses, transportation costs, and other expenses relating to the provision of service.
2.5 The Company may first provide service by way of Remote Support in order to diagnose or resolve issues preliminarily. Where an issue is resolved without the need for a site visit, such Remote Support shall be deemed to constitute the provision of warranty service.
2.6 The Company shall determine the appropriate mode of service by reference to the nature of the issue, safety considerations, engineering suitability, and the effectiveness of the resolution. The Company may require that the Product be returned for inspection prior to any onsite attendance where the Company considers this to be the more appropriate course.
2.7 The provision of service free of labor charges, service charges, and travel expenses under Clause 2.1 shall apply only to work performed during the Company’s normal business days and hours, being Monday to Friday, 08:30 to 17:30 hours (Thailand time), excluding public holidays and holidays announced by the Company. Where the Purchaser, or the rules and requirements of the installation site, require work to be performed outside such days or hours — including, without limitation, work at night, on Saturdays, Sundays, or holidays, or during plant shutdown periods — the Purchaser shall be responsible for overtime charges, after-hours service charges, and related additional expenses, at the rates published by the Company or as otherwise agreed in writing prior to commencement of the work, notwithstanding that such work falls within the warranty period or the Onsite Service period under Clause 2.1.
2.8 Where the Product is installed in a position or area with restricted access — including, without limitation, heights beyond the reach of the service technician’s standard ladder, areas requiring scaffolding, aerial work platforms, lifting machinery or other elevation equipment, confined spaces, or areas requiring any other special equipment or measures for access — the Purchaser shall arrange for such equipment, together with a qualified operator (where applicable), to be ready prior to the appointment date, or shall be responsible for all rental, installation, dismantling, and related costs. Such costs shall in no circumstances fall within the scope of the warranty or the free Onsite Service under Clause 2.1.
2.9 Where the installation site imposes specific rules or requirements for work attendance — including, without limitation, pre-entry safety training, work permits, the presence of supervisors or safety watchers, special personal protective equipment, certification documents, medical examinations, additional insurance, or escorted site access — the Purchaser shall notify the Company of such requirements in advance of the appointment, and shall be responsible for the associated costs, fees, and any additional labor or service charges arising from the time required to comply with such requirements, at the rates published by the Company. Where the Purchaser fails to give such advance notice and the Company is thereby unable to perform the work on the appointment date, Clause 6.2 shall apply.
2.10 The Onsite Service under these Terms is provided by prior appointment, subject to service queue availability and the readiness of both parties. It does not constitute a Service Level Agreement (SLA), and shall not be construed as any guarantee of response time or time to resolution, nor does it include the provision of substitute equipment during repair (loan units). Where the Purchaser requires guaranteed response times, regular after-hours service, loan units during repair, or scheduled preventive maintenance, such services may be provided under a separate Maintenance Agreement pursuant to the Company’s proposal.
2.11 For the purpose of prompt diagnosis and resolution of issues under Clause 2.5, the Purchaser shall provide reasonable facilitation of remote access to the system, including, without limitation, authorizing network connections, coordinating with the Purchaser’s information technology department, or designating an onsite contact person. Where Remote Support cannot be provided by reason of restrictions on the Purchaser’s side, the Company shall schedule an onsite attendance at the installation site in accordance with this Section.
3. Service Request Procedure
3.1 The person requesting service must present verifiable proof of purchase.
3.2 The person requesting service must provide the product model, serial number, a description of the fault, the installation location, together with photographs or such other information as is necessary for diagnosis of the issue.
3.3 The Company may request that the Purchaser carry out preliminary checks or tests in accordance with the instructions of the service department before the Product is accepted for inspection or before a site visit is arranged.
3.4 Where, upon inspection, the Product is found to be in normal working condition, or the issue is found not to originate from the Product (No Fault Found: NFF), the Company shall be entitled to charge inspection fees, labor charges, travel expenses, and other expenses actually incurred, at the rates published by the Company.
3.5 Where the damage is found to fall outside the scope of this warranty, the Company shall notify the Purchaser of the details and the applicable charges before proceeding.
4. Warranty Entitlements
4.1 The product warranty and the Onsite Service are separate and independent entitlements. Entitlement to one shall not give rise to entitlement to the other.
4.2 The repair of a Product, the replacement of parts, or the replacement of a Product shall not cause the warranty period to recommence, nor shall it extend the original warranty period.
4.3 The warranty attaches to the Product itself. The person requesting service must hold verifiable proof of purchase.
5. Warranty Exclusions
This warranty shall not cover any of the following:
5.1 Installation or use of the Product otherwise than in accordance with the manufacturer’s manuals or specifications.
5.2 Modification, alteration, repair, or change to the Product by any person not authorized by the Company.
5.3 Damage caused by dropping, impact, accident, or misuse.
5.4 Damage caused by voltage drop, overvoltage, power surge, lightning, short circuit, or an electrical system that does not conform to the manufacturer’s specifications.
5.5 Damage caused by water, moisture, chemicals, dust, insects, rodents, or animals, provided that this exclusion shall apply only where such conditions exceed the manufacturer’s environmental specifications for the relevant Product model.
5.6 Damage caused by fire, flood, earthquake, natural disaster, or force majeure.
5.7 Removal, alteration, or illegibility of the serial number or warranty sticker such that verification is not possible.
5.8 Damage caused by use of the Product in conjunction with equipment that does not conform to the manufacturer’s specifications.
5.9 Damage to data, software, firmware, or system configurations.
5.10 Consumable items, including, without limitation, batteries, fuses, lamps, connecting cables, or materials subject to wear and tear through ordinary use, except where the failure results from a manufacturing defect.
5.11 Any product, equipment, fixture, component, or accessory sold under any trademark other than Risco and Maxwell, as provided in Clause 1.9, including any damage to Risco or Maxwell Products caused by a defect or malfunction of any product or equipment sold under such other trademarks.
6. Expenses Borne by the Purchaser
6.1 Where, upon inspection, the damage is found to fall outside the scope of this warranty, the Purchaser shall be responsible for inspection fees, labor charges, spare parts costs, travel expenses, transportation costs, and other related expenses, at the rates published by the Company.
6.2 Where the Company attends the site on the scheduled date and time but is unable to perform the work by reason of the Purchaser’s unavailability, absence from the premises, inability to access the installation area, or any other cause attributable to the Purchaser, the Purchaser shall be responsible for the travel expenses and other expenses actually incurred.
6.3 The submission of a claim, the delivery of a Product for inspection, or the exercise of any warranty right shall not entitle the Purchaser to withhold, delay, or refuse any payment that has fallen due, except as otherwise provided by law.
6.4 The service rates, excess travel charges, after-hours work charges, and other rates published by the Company pursuant to these Terms shall be made available on the Company’s website and shall be provided to the Purchaser upon request. Before undertaking any chargeable work, the Company shall in every case submit a cost estimate to the Purchaser for approval.
7. Limitation of Liability
7.1 The Company’s liability under this warranty shall be limited to the repair of the Product, the replacement of parts, or the replacement of the Product in accordance with these Terms.
7.2 The Company shall not be liable for any indirect damage, consequential damage, loss of data, loss of profits, loss of revenue, business interruption, or any other consequential loss arising from the use of, or inability to use, the Product, except where such liability arises from the Company’s willful misconduct or gross negligence, or where liability is imposed by mandatory provisions of law.
8. Warranty Registration and Acceptance of Terms
8.1 The Purchaser may register the product warranty through the channels designated by the Company, and must provide information that is accurate, complete, and true, including the Purchaser’s full name or juristic person name, contact details, product model, serial number, date of purchase, installation location, and proof of purchase.
8.2 Clicking to accept these Terms through the online registration system constitutes a lawful expression of intent to accept each and every provision of these Terms, and shall be binding to the same extent as a signature affixed to a written document. The Company shall retain records of such acceptance, the date and time of acceptance, and the version of the Terms in force at that time, as evidence.
8.3 Where the person registering acts on behalf of a juristic person or another person, the person registering represents and warrants that he or she is duly authorized to act on behalf of such person.
8.4 The provision of information that is false, inaccurate, or materially incomplete may result in the termination of warranty entitlements or the refusal of service.
8.5 The Company shall collect, use, and process the personal data of the person registering only to the extent necessary for warranty registration, the provision of services, and related communications, in accordance with the Personal Data Protection Act B.E. 2562 (2019) of Thailand, with further details as set out in the Company’s Privacy Policy.
8.6 The 3 (three) year warranty under Section 1 and the Onsite Service entitlement under Section 2 of these Terms are privileges granted by the Company to Purchasers who register the warranty and click to accept these Terms within 60 (sixty) days from the Warranty Commencement Date under Clause 1.1. Where registration is not completed within such period, the Purchaser shall retain such rights as are conferred by law, and the Company may, at its discretion and on a case-by-case basis, grant the entitlements under these Terms where the Purchaser produces verifiable proof of purchase.
9. General Provisions
9.1 The determination of the cause of any defect and the assessment of warranty entitlement shall be made in accordance with engineering principles, recognized technical standards, industry standards, and verifiable technical data of the manufacturer.
9.2 The Company reserves the right to amend or revise these Terms as it considers appropriate, provided that the terms applicable to each Product shall be the version of the Terms accepted by the Purchaser as at the date of warranty registration.
9.3 If any provision of these Terms is or becomes void or unenforceable, such provision alone shall be ineffective, without prejudice to the validity and enforceability of the remaining provisions.
9.4 These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand.
9.5 Nothing in these Terms shall limit or exclude any right of a Purchaser who is a consumer under the laws on consumer protection, the laws on liability for damage arising from unsafe products, or any other applicable law. Where any provision of these Terms conflicts with any such right, that provision shall apply only to the extent not contrary to such law.
9.6 These Terms are made in the Thai language. Where these Terms are translated into any other language and any inconsistency arises between the versions, the Thai language version shall prevail.
